The customer assumes all risk in the goods at the time of dispatch and it is the customer’s discretion to insure all goods that are at risk.
If the customer requests an order to be sent to a third party, the risk rests with the customer only. Happifeet Podiatry accepts no liability on any order sent to a third party.
The parties hereby agree that the proper law of all contracts arising between the customer and Happifeet Podiatry is the law of the State of Queensland and the parties here to agree to submit to the jurisdiction of the Courts of that State.
These terms and conditions are the only contractual terms which are binding upon Happifeet Podiatry as well as any conditions which are imposed and cannot be excluded by law. All other conditions, warranties, representations, statements and obligations, whether expressed or implied are to the extent permitted by law hereby expressly excluded.

All visitors to our website are entering a binding legal agreement on the terms and conditions contained herewith when using the website. This contract is between the visitor and Happifeet Podiatry and by using this website means acceptance of these terms and conditions.
We reserve the right to amend the terms and conditions from time to time. It is your responsibility to check the terms and conditions before placing your order and/or using our website. Your continued use of the Happifeet Podiatry website will be taken to be acceptance of the new terms.
You may place an Order through the Website by submitting an electronic Order on the Website.
An Order submitted by you on the Website in the manner described on the Website is an offer by you to purchase Goods for the Price (plus any Delivery Fee and for the avoidance of doubt, GST) as specified at the time you submit your Order. That offer cannot be withdrawn by you without our consent.
Prior to shipment, Happifeet Podiatry will advise if there is any item/s unavailable and/or offer an alternative product to you. Any item/s that are mutually agreed to be placed on backorder will be shipped as soon as the item is available. If the item/s is no longer available, Happifeet Podiatry will refund the unit price for the missing item/s only. Happifeet Podiatry has the sole legal right to determine to refund, or supply new or replacement items on any order that is delivered with missing or incorrect items.
Happifeet Podiatry will try to deliver all products on time but are not responsible or legally liable for any delays in delivery to the purchaser including if products are not delivered by a specified due date.
You acknowledge that despite our reasonable precautions, products may be listed at an incorrect price or with incorrect information or may be unavailable. This may be due to an error or similar oversight. We reserve the right to cancel an order in that event.
We may also cancel an order if we believe that it is being made in contravention of this agreement, or in contravention of the rights of any person or any law. We may cancel an order even if it has been confirmed and the customer has paid in full. We reserve this right up until the time of delivery of the product to that customer. If a cancellation of this nature occurs after the customer has been charged for the product, we will immediately refund the customer using the same payment method used for purchase for the amount in question.
Delivery will be made by postal or courier service at Happifeet Podiatry discretion.
You acknowledge and agree that notwithstanding anything else stated on the Website that Happifeet Podiatry cannot guarantee that delivery will occur in the stated delivery time frames, delivery time frames may change from time to time due to unforeseen circumstances; and except where required by applicable law, Happifeet Podiatry is not liable with respect to any loss, damage, cost, expense or injury you or any third party suffers as a result of a change in delivery times or a delay in delivery.
Happifeet Podiatry will not be liable for any loss suffered by you if you provide us with incorrect delivery details. It is your responsibility to ensure Happifeet Podiatry has current details of your postal/delivery address and all other details.
Happifeet Podiatry will only accept returns subject to the following conditions;
1. The customer must directtly contact Happifeet Podiatry regarding with the items they are wishing to return. By contacting Happifeet regarding the items the customer wishes to return, the customer accepts responsibility for having read the Returns and Exchange Information which relates to and is outlined in our Returns and Exchanges Policy.
2. All items must be returned to Happifeet Podiatry within 30 days of purchase date.
If there is any missing item/s in the order, the customer must notify Happifeet Podiatry in writing within 48 hours of receipt of the goods.
Shipping costs will be at the expense of the customer.
Discontinued stock items are not eligible for return unless agreed on prior to return by Happifeet Podiatry
Goods returned must be in the original condition as sent, this includes the boxes unmarked and all contents intact or they will not be accepted for credit or refund.
When you place an online or offline order with Happifeet Podiatry you are entering into a contract between you as a single entity, the company or organisation you represent and Happifeet Podiatry. By placing your order you agree to be bound by our Terms and Conditions.
All prices are subject to change periodically. If goods are out of stock, we will quote the price accordingly.
All vouchers received as a prize or apart of a promotion cannot be used in conjunction with any other offers or sales and must be redeemed on full price products only. These vouchers cannot be redeemed for cash and expire on the date specified on the voucher.
When a gift voucher is purchased by a customer and they provide payment the full value of the voucher then this is a gift voucher and is considered to be a method of payment and therefore will be accepted for the purchase of any products sold in store either full price or on sale. These vouchers however cannot be redeemed for cash and expire 12 months from date of issue, unless stated otherwise.
